Terms of Service

1. Acceptance of Terms
By accessing or using the Alkimify platform and services (“Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our Services. These Terms constitute a legally binding agreement between you and Alkimify.
2. Description of Services
Alkimify provides credit infrastructure services for the African market, including:
- Data Refinery — a platform that transforms informal financial data (photos, voice notes, mobile money logs) into structured, machine-readable credit data
- Afri-Score — a credit scoring system designed for informal and semi-formal economic activities in Africa
- Credit intelligence reports — structured financial profiles and analytics for lending decisions
- API and integration services — enabling financial institutions to access credit intelligence programmatically
3. Eligibility
To use our Services, you must be at least 18 years of age and have the legal authority to enter into a binding agreement. If you are using our Services on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access to or use of your account at info@alkimify.com.
5. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable laws
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorised access to our systems or data
- Interfere with or disrupt the integrity or performance of the Services
- Reverse engineer, decompile, or disassemble any part of the platform
- Use the Services to discriminate against any individual or group
- Resell, redistribute, or sublicence access to the Services without our written consent
6. Data Submission
When you submit data to the platform, including receipts, invoices, voice notes, mobile money records, and other financial documents, you represent and warrant that:
- You have the right to submit such data
- The data is accurate and not misleading to the best of your knowledge
- The submission does not infringe upon the rights of any third party
- You have obtained any necessary consents from data subjects
7. Credit Assessments
Credit scores and intelligence reports generated by Alkimify, including Afri-Score assessments, are provided for informational and advisory purposes. Final lending and credit decisions are made solely by the partner financial institutions. Alkimify does not guarantee approval of any credit application or financial product.
8. Intellectual Property
All intellectual property rights in the Services, including but not limited to software, algorithms, data models, trademarks, and content, are owned by Alkimify or its licensors. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted.
9. Fees and Payment
Certain Services may require payment. Fees, billing cycles, and payment terms will be specified in your service agreement or on the applicable pricing page. All fees are non-refundable unless otherwise stated.
10. Limitation of Liability
To the maximum extent permitted by law, Alkimify and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, including but not limited to loss of profits, data, or business opportunities.
11. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied. Alkimify does not warrant that the Services will be uninterrupted, error-free, or completely secure.
12. Indemnification
You agree to indemnify and hold harmless Alkimify and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, upon reasonable notice. You may terminate your account by contacting us at info@alkimify.com. Upon termination, your right to use the Services ceases immediately.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. For matters relating to our operations in Cameroon, applicable local laws and CEMAC regulations may also apply.
15. Dispute Resolution
Any disputes arising from these Terms or the use of our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the platform or via email. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
